TERMS AND CONDITIONS OF SERVICE

These terms govern the relationship between Nikola Nikolov , acting as a freelancer/independent contractor (hereinafter “Contractor” or “We”) and the users (hereinafter “Client”) of the services offered through the instasmart.bg website.

I. SCOPE OF SERVICES The Contractor provides expert and software services in the field of home automation (“Smart Home”), which include:

1. Consulting, system design, and hardware recommendations.
2. Software setup, device pairing, and creating automations.
3. Integration of devices into a unified ecosystem (e.g., Home Assistant, Apple Home, Google Home). The Contractor DOES NOT sell hardware and DOES NOT perform physical electrical wiring or installations on the 220V grid.

II. QUOTES, PRICES, AND PAYMENT

1. Prices for consulting and software integration are based on project complexity and the number of devices.
2. The Contractor provides a custom Quote, valid for 14 days.
3. An advance payment of 50% may be required to start the project. The remaining balance is due upon successful software integration and testing.

III. CLIENT OBLIGATIONS

1. The Client must purchase the necessary hardware with their own funds from retailers of their choice.
2. Critical: The Client must hire a certified electrician for the physical installation of all smart devices (relays, switches) to the electrical grid before the Contractor begins the software setup.
3. The Client must provide a stable internet connection (Wi-Fi/LAN) required for the Smart Home system.

IV. LIABILITY AND LIMITATIONS

1. Hardware Liability: As the Contractor does not sell or physically install the hardware, they bear NO liability for defective devices, power surges, fires, or property damage caused by faulty hardware or improper wiring by third parties.
2. Software Guarantee: The Contractor guarantees the proper functioning of the software automations at the time of project handover.
3. The Contractor is not responsible for Smart Home failures due to: Internet/power outages; Wi-Fi password/router changes by the Client; Physical resets by the Client; Cloud server crashes of the manufacturers (e.g., Tuya, Shelly).

V. OTHER TERMS The Contractor reserves the right to amend these Terms at any time. All unresolved matters are governed by the laws of the Republic of Bulgaria.
